At Maxium, we understand the importance of privacy and the protection of personal information. Doing business with a financial services provider involves sharing personal information and we have always placed the highest value on ensuring the confidentiality of this privileged information. We have prepared these Policies to inform you of our ongoing commitment to ensuring that all personal information obtained from our process is accurate and remains confidential.

What is personal information?

We consider "personal information" to mean any information, recorded in any form, about an identified individual, other than business contact information (e.g. name, title, business address). Maxium, in the course of its activities, will collect personal information, which may include:

  • Identification information such as name, home address, telephone, personal email address, date of birth, social insurance number (SIN) and marital status;
  • Employment information such as salary, job title, references;
  • Other information necessary to Maxium's purposes, which may be voluntarily disclosed in the course of our relationship

Why Maxium Collects Personal Information

Maxium will collect, use and may disclose your personal information for the purposes of:

  • Determining customer eligibility for financial products, including identifying customers or guarantors; assessing credit applications and conducting initial and periodic credit checks;
  • Where circumstances require, collecting amounts outstanding from customers and those providing security for clients;
  • Protecting against fraud; or
  • Meeting legal and regulatory requirements, including tax or other reporting requirements

How Maxium Collects and Uses Personal Information

Maxium will only collect, use and disclose personal information for purposes that would be considered reasonable under most circumstances. We use only fair and lawful methods to collect personal information. Unless permitted by law, no personal information is collected without first obtaining the consent of the individual to the collection, use and dissemination of that information. Our use of personal information is limited to the purposes described in this Policy and we do not sell, trade, barter, exchange or disclose for consideration any personal information we have obtained.

Personal information will be collected, to the extent possible, directly from the individual concerned. We may collect and use personal information from external sources, including references you have provided, small independent leasing companies, credit bureaus or other groups or companies where collection is necessary for the purposes described above. For example, we need to know an individual's credit worthiness for credit purposes where a person serves as a guarantor and we may contact other lenders or credit bureaus to obtain information on their credit history.

When Maxium May Disclose Your Personal Information

Maxium may disclose your personal information to credit bureaus or financial institutions involved in determining initial and ongoing customer eligibility for products and services; who are bankers or funders of Maxium; who are involved in the transfer of all or part of the assets or business of Maxium in connection with the securitization, sale, assignment and/or financing or our financial transactions; who are in the payment system including financial institutions or payment organizations; or who are maintaining, reviewing and developing our business systems, procedures and infrastructure including testing or upgrading our computer systems.

Your Consent

Your provision of personal information to Maxium means that you agree and consent that we may collect, use and disclose your personal information in accordance with this Privacy Policy. In most cases, and subject to legal and contractual restrictions, an individual is free to refuse or withdraw his or her consent at any time upon reasonable, advance notice. If you have a credit product or have provided a guarantee, you may not withdraw your consent to share your personal information with other lenders and credit bureaus as it is necessary to support the credit approval process.

The Accuracy and Retention of Personal Information

Maxium endeavors to ensure that any personal information in our possession is as accurate, current and complete as necessary for the purposes for which we use that information. We keep your personal information only as long as it is required for the reasons it was collected. The length of time we retain information varies, depending on the product and the nature of the information. This period may extend beyond the end of your relationship with us but it will be only for as long as is necessary for us to have sufficient information to respond to any issues that may arise at a later date. When your personal information is no longer required, we will destroy, delete or erase it into an anonymous form.

Protection of Personal Information

Maxium endeavors to maintain appropriate physical, procedural and technical security so as to prevent any loss, misuse, unauthorized access, disclosure or modification of personal information. We further protect personal information by restricting access to it to those employees identified by management as requiring access to it and for professional reasons only. We audit our procedures and security measures on an ongoing basis to ensure our systems remain effective and appropriate.

Access to Your Personal Information

Maxium permits the reasonable right of access and review of personal information held by us about an individual and will endeavor to provide the information in question within a reasonable time. To guard against fraudulent requests for access, we may require sufficient information to allow us to confirm that the person making the request is authorized to do so before granting access.
